Justin has full expertise as a senior tax lawyer having practised extensively in the area as an accountant and solicitor prior to coming to the Bar. He advises and litigates on a wide range of complex taxation issues including income tax, capital gains tax, stamp duty and GST (in which he has a particular interest). As such, he is uniquely placed to provide collaborative, practical and commercial tax solutions for a range of clients, from individuals and small business owners to large corporations and government departments.
Justin has advised on tax issues relating to corporate advisory, mergers and acquisitions, resources and energy, commercial property and family law, as well as on complex issues including the tax aspects of capital raisings, business acquisitions and disposals, and restructuring.
As well as traditional “front end” tax advice work, Justin also has experience in tax controversy and has appeared on matters in the AAT, Federal Court and High Court of Australia.
Justin is an active member of the tax law community, having contributed to a number of eminent committees and is a regular speaker at Taxation Institute of Australia functions.

> Instructing solicitor in relation to the Full Federal Court appeal and High Court cross appeals in Thomas v FCT, a case concerning the flow of franking credits through a discretionary trust (Mark Robertson QC and Lister Harrison QC).
> Running a 3 day AAT hardship matter without Counsel.
> Running an AAT matter concerning asset betterment/unexplained bank deposits (Peter Bickford).
> Instructing solicitor for the Meriton Apartments Group in relation to a large Federal Court tax appeal.
> Instructing solicitor in relation to Hii v FCT, concerning residency, fraud and evasion (Graham Gibson QC and Anthony Anderson).
> Advising a household retail brand (privately owned) in relation to the forgiveness of pre December 2009 unpaid present entitlements.
> Assisting Queensland Rail to undertake a review (over 5 months) of their contracts for GST purposes.
> Advising the Mater Hospital in relation to FBT issues associated with its nursing staff and doctors.
> Advising on all aspects of business sales and purchases and asset transactions for a variety of clients including high net wealth individuals, the mining sector and manufacturing businesses.
> Successfully obtaining private rulings from the Australian Taxation Office for industry associations, major recreational clubs and sporting bodies, as well as obtaining deductible gift recipient status for these clients.
> Advising the Commonwealth of Australia (Prime Minister’s Office) on GST and issues associated with the importation of aircraft into Australia.
> Providing specialist advice to family law clients on the taxation aspects of property settlements.
> Providing specialist GST advice to accounting firms acting as receivers and mortgagees in possession selling property.
> Advising the Australian Olympic Committee (AOC) on general corporate tax issues in relation to the 2000 Sydney Olympics.
> Advising on leveraged lease/major asset acquisitions (including large infrastructure projects) for Victoria Rail and Qantas.
> Advising on PRRT issues (including relevant clauses) arising out of gas sale agreements.
> Advising on the Singtel/Optus merger, including consideration of a variety of tax issues.
> Advising clients, including Canadian companies, on inbound tax structures for foreign tax resident entities coming to Australia.
> Advising an entity contracting with Bluescope Steel on Australian withholding tax obligations, including successful applications for variation of withholding rates.
> Advising a key entity in the fruit and vegetable industry in relation to the grouping provisions contained in the Queensland payroll tax legislation.
> Advising a large employer in the building industry industry in relation to whether certain contracting arrangements were included within the payroll tax base.
> Advising in relation to various small business CGT concession issues.
