This appeal considered the matter where a police officer breached a court order requiring him to only drive vehicles fixed with an interlock device and where the police commissioner commenced disciplinary proceedings. The reviewer found the police officer’s conduct did not constitute misconduct but the court considered whether the reviewer took into account irrelevant considerations and whether it was ‘unreasonable’ for the reviewer to characterise the conduct as a disciplinary breach but not misconduct.
