These proceedings concerned applications by Brighton Pacific Pty Ltd (“Brighton”), a provider of vocational education and training, for review of decisions made by the Australian Skills Quality Authority (“ASQA”). The decisions included decisions to cancel Brighton’s registrations under the National Vocational Education and Training Regulator Act 2011 (Cth) and the Education Services for Overseas Students Act 2000 (Cth) (“Cancellation Decisions”), and decisions to reject applications by Brighton to amend the scope of its registrations (“Scope of Registration Decisions”).
The Administrative Appeals Tribunal set aside the Cancellation Decisions and reinstated Brighton’s registrations for 3 years. The Tribunal affirmed the Scope of Registration Decisions.
