This case concerned defamation proceedings brought by a previous Minister for Housing and Public Works against their former Senior Media Advisor. The defendant applied to stay the defamation proceeding until an associated criminal proceeding had been determined. In rejecting the stay application, the Court concluded that the defendant had not demonstrated that defending the defamation proceedings at trial would prejudice his position in the criminal proceedings.
Michael May (with N H Ferrett) appeared for the plaintiff, instructed by CooperGraceWard.
