The matter concerned whether the effect of the Liquor Act 1992 and Liquor Regulation 1992 prohibiting possession in a public place of an amount of alcohol that was less than lawful in other parts of Queensland were inconsistent with s.10 of the Racial Discrimination Act (“the RD Act”). The Court held that the impugned provisions were a “special measure” under s.8(1) of the RD Act and s.10 of that Act did not apply.
