The judgment is for a retrial ordered in a successful appeal against conviction of a joint murder charge for defendants, TAZ and SED.
The primary issues considered were whether TAZ had committed murder pursuant to s 302(1)(a) of the Criminal Code Act 1899 (Qld) (Criminal Code), whether SED was criminally liable for aiding or acting in common purpose with TAZ, pursuant to ss 7(1)(c) and 8 of the Criminal Code, and whether any defences were available to them.
The Court held that no defences were available to TAZ and was guilty of murder. Similarly, the Court held that no defences were available to SED. SED was not found guilty of murder but, was guilty of manslaughter.
