The primary issues considered were whether to grant an extension to the limitation period for the plaintiff under the s 31 of the Limitations of Actions Act 1974 (Qld) pursuant to s 59(2)(b) of the Personal Injuries Proceedings Act 2002 (Qld), as well as leave to amend their statement of claim to plead breaches of sch 2 of the Competition and Consumer Act 2010 (Cth).
The court made orders granting the plaintiff, an extension to the limitation period pursuant to s 59(2)(b) of the Personal Injuries Proceedings Act 2002 (Qld) and leave to have made and filed the amended reply without distinguishing amendments pursuant to rules 376(4) and 382(1) of the Uniform Civil Procedure Rules 1999 (Qld).
