An appeal from a decision in which the appellant’s claim for medical negligence against a doctor and a hospital (arising from in-hospital treatment of the appellant, an 80 year old woman, who had suffered a stroke) had been dismissed at first instance. The appellant unsuccessfully sought to adduce further evidence on appeal. The appeal was dismissed.
Matthew Hickey appeared for the successful respondent (and appeared at first instance) instructed by Minter Ellison.
