Prosecution by way of the Work Health and Safety Act 2011 (Qld) was commenced following an incident at a zinc refinery which led to a death. The respondent rejected the applicant’s proposal of a written undertaking. The applicant sought judicial review of the decision rejecting the undertaking and alleged breach of the rules of natural justice.
