A matter concerning appropriate characterisation of and sanctions for a barrister’s conduct which included making written submission and opening a case with statements as to facts contrary to material in his brief. Issues included the making of a non-publication order, the nature of a reprimand available in a case where non-publication is ordered, and whether the causative role of the applicant in the original conduct constitutes “extraordinary circumstances” such as to warrant a departure from the usual order as to the applicant’s costs.
