Sean has a broad commercial practice, with a particular focus on cases concerning bankruptcy, corporate insolvency, contracts, equity, professional negligence and Corporations Act matters.
Prior to being called to the bar, Sean worked for four years as a solicitor in a boutique commercial litigation and insolvency firm. He has represented a diverse group of domestic and international clients, including insolvency practitioners, creditors, solicitors, miners, property developers, farmers, manufacturers and investors. Sean has acted in matters at all levels of the State and Federal Courts and in the High Court.
Significant matters as a solicitor include:-
› acting for the liquidators of a company which was the responsible entity and manager of numerous registered and unregistered managed investment schemes, with several hundred million dollars in funds under management in relation to a variety of issues arising from the liquidation;
› acting for farm owners whose land was subject to a claim for a constructive trust based on contributions to a common business endeavour at trial, on appeal and in the High Court;
› acting for a multinational manufacturer of construction materials in numerous pieces of litigation, including defending an unfair preference claim of approximately $1.5 million, pursuing guarantors for significant outstanding debts and an application to preserve vested securities under the Personal Property Security Act 2009;
› acting for liquidators in relation to a claim for breach of director’s duty against former officers of the company.
