Danielle has significant commercial law and advisory experience, having practised as a solicitor in commercial litigation for 19+ years (including 12+ years at Clayton Utz Lawyers in Brisbane).
Prior to being called to the Bar, Danielle was a Special Counsel at Clayton Utz. In that role, Danielle specialised in the conduct of complex commercial litigation and large-scale insurance coverage disputes, particularly for clients in the energy and resources, major projects, government, property and financial services sectors.
Danielle has experience appearing for clients in the State and Federal Courts, as well as in mediations and other forms of alternative dispute resolution.
Danielle is regarded as a trusted advisor and is valued for her strong work ethic and her calm, considered and professional approach.
Experience
Recent experience as a barrister includes:
> Acting (led by R. Anderson KC) in Federal Court proceedings for one of Australia’s largest providers of professional trustee services in relation to a claim against a firm of financial advisers alleging misleading and deceptive conduct in contravention of the Australian Consumer Law.
> Acting (led by D. Chesterman KC) in Supreme Court proceedings in a dispute concerning a party’s entitlement to call on bank guarantees.
> Appearing (led by M. Hodge KC and others) in a Supreme Court trial involving the financing of three aged care facilities to be operated by the Presbyterian Church of Queensland, and concerning the law of charitable trusts and statutory unconscionable conduct.
> Acting (led by P. Dunning KC and others) in Supreme Court proceedings for the owners of a large-scale CSG to LNG project in relation to various complex claims for indemnity made under contract works policies of insurance.
> Acting (led by S. Doyle KC and S. Spottiswood) in Federal Court proceedings concerning a dispute regarding a joint venture agreement.
> Acting (led by D. Butler KC) in Supreme Court proceedings concerning a dispute about the payment for services performed under an engineering contract.

Commercial Litigation
> Acting in two Supreme Court proceedings for the owner of a large-scale CSG to LNG project concerning its acquisition of certain gas interests and the operation of the project.
> Acting in Supreme Court proceedings for the liquidators of a property developer in a claim concerning the development of the Royal Pines Resort.
> Acting in Supreme Court proceedings for the manufacturer of a tile cleaning product in defence of a subrogated claim pursued by insurers. Successfully obtained orders having the proceeding dismissed for want of prosecution.
> Acting in Supreme Court proceedings in a dispute regarding the taking of confidential information, which included the obtaining and execution of an Anton Piller order.
> Acting in New South Wales Supreme Court proceedings for a builder in dispute with a property developer regarding the construction of several residential townhouses.
Financial Services
> Acting for a national bank in the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry.
> Acting for a national stockbroking firm in defence of claims that were pursued against it and its authorised representatives alleging the provision of negligent advice in the conduct of its financial services business.
Insurance
> Acting in Supreme Court proceedings for the owners of a large-scale CSG to LNG project in relation to various complex claims made against insurers under contract works policies of insurance.
> Acting in Federal Court proceedings for various insureds in the second AFCA COVID-19 business interruption insurance test case.
> Acting for a mining company in a complex property damage and business interruption insurance claim relating to damage caused by the 2011 Queensland floods.
> Acting for an “alliance” project in a significant insurance claim concerning the design and construction of its advanced water treatment plant.
> Acting and advising in respect of numerous insurance claims, both for insurers and insureds (including contract works, ISR, professional indemnity, business interruption, D&O, public liability).

> Acting in Supreme Court and Court of Appeal proceedings for an independent fuel company in a complex leasing dispute.
> Acting in Supreme Court and Court of Appeal proceedings for the owner of a hotel group in relation to a dispute with the State of Queensland about the proper construction of a lease.
> Acting in complex District Court proceedings for a property developer against the State of Queensland concerning the alleged incorrect assessment of land tax.

> Acting for an entertainment venue in a complex regulatory investigation relating to a food poisoning outbreak.
> Acting for employers in various workplace health and safety investigations and prosecutions.
