The appellant sought judicial review of a decision of the Minister declining to revoke the cancellation of his visa. The primary judge refused the application. The appellant appealed to the Full Court of the Federal Court.
Kenny, Kerr and Wheelahan JJ allowed the appeal. Their Honours held that the Minister did not engage with and give genuine consideration to the clearly articulated and significant representations that were made relating to the risk of harm to the appellant.
