This was an appeal to the Queensland Court of Appeal brought by the Appellant against the decision at the first instance for summary judgment of part of the Respondents’ claim. The Respondents’ alleged that the Appellant had made voidable transactions, as director of the Second Respondent, being unreasonable director related transactions for which relief was claimed pursuant to ss 588FF of the Corporations Act 2001 (Cth). The Appellant was partially successful in their appeal in relation to $34,000 of the summary judgment award of $117,824.75. The successfully appealed payments were made whilst the Appellant was not in fact a director of the Second Respondent, which was a fact conceded by the Respondents on appeal. The balance of the summary judgment was upheld.
