The Defendants applied to strike out the tenth version of the Plaintiff’s statement of claim on the basis of a defective pleading of causation. The statement of claim was struck out, without leave to proceed, and the proceeding was dismissed for want of prosecution. The Defendants had never been required to file a defence in the proceeding.
