The plaintiff was a former police officer who sued the State of Queensland and other police officers for damages for and alleged reprisal. He alleged that the police officers had taken reprisal action against him because he complained of alleged “official misconduct” committed by another police officer. The plaintiff claimed whistleblower protection for having made an alleged “public interest disclosure”.
The District Court dismissed the claim, finding that the plaintiff had not made a “public interest disclosure” and that no reprisal action was taken against him.
The plaintiff appealed. On 21 November 2023, the Court of Appeal dismissed the appeal.
Scott McCleod KC and Matthew Wilkinson appeared for the State of Queensland and the police officer defendants, instructed by Crown Law.
