An application to amend a statement of claim filed in proceedings as grounds of opposition to orders sought.
The Court was not satisfied an explanation for failure to plead this claim in multiple earlier versions of the document was provided. Additionally, the Court held there was a risk any trial adjournment would have negative flow-on effects where finalising the liquidation was in the public interest, as well as on the Court’s resources and to the other parties .
