Today the High Court of Australia pronounced judgment in Robinson Helicopter Company Incorporated v McDermott & Ors, an appeal from the Queensland Court of Appeal.
Shane Doyle QC and Matthew Hickey appeared for the successful appellant, Robinson Helicopter Company Incorporated, the American manufacturer of the popular light helicopter, the R22. They were instructed by Peter Axelrod of Meridian Lawyers.
The claim (which sought damages of approaching $80m) concerned allegations of negligence and breaches of the product liability provisions of the Trade Practice Act, in the publication of the R22’s maintenance manual, following a fatal accident on a vast cattle station in the Northern Territory.
Matthew Hickey also appeared at first instance (led by Glenn Newton QC) and in the Court of Appeal.
