The plaintiff sought a debt due and owing, or alternatively damages, in relation to services provided under a Consultancy Agreement and the subsequent entry into a Deed of Agreement between the plaintiff and the first and second defendants. There were three applications related to this matter. The first, by the plaintiff for summary judgment against the first and second defendants. The second was for security of costs by the first and second defendants. The third was for security for costs by the third to fifth defendants.
The Court dismissed the plaintiff’s application for summary judgment. Pursuant to r 670 of the Uniform Civil Procedure Rules, the Court ordered the plaintiff provide security for costs for the first and second defendants, as well as security for costs for the third to fifth defendants.
