This case concerned the determination of costs for a three-day hearing in which the defendant was partially successful in obtaining the relief he sought. The primary issue was whether the defendant was entitled to all of his costs on the basis he was generally successful in obtaining the alternative relief sought. Brown J held the appropriate order was for the plaintiffs to pay 60 per cent of the defendant’s costs of and incidental to the defendant’s application.
