Following an earlier decision, in which Barlow QC DCJ made orders for specific performance against a buyer who had failed to complete the purchase of a residential development in Canberra, the developer (vendor) sought orders for specific performance against the guarantors of the buyer’s obligations under the contract.
Barlow QC DJC granted orders against the guarantors.
