This proceeding involved an appeal against the refusal of a development application to construct a retirement facility in a low-density residential zone at Forrest Lake. The proposed development was initially refused for failing to meet the criteria for low-density development. Among other factors, the court analysed the height of the facility, the inconsistencies between zoning provisions, the congruency between the design and nature of the neighbourhood and the need for a retirement facility. The appeal was allowed.
