This case concerned the principles to be applied when seeking to have the Court make a declaration under rule 371(2)(d) of the Uniform Civil Procedure Rules 1999 (Qld) that an irregular step under the rules be deemed to have been effective, and the interaction between seeking such a declaration and the need to seek leave under rule 389 after more than 2 years has elapsed since a (regular) step was last taken in a proceeding.
