James Green (led by Peter Roney QC) acted for the purchaser of a small shopping centre on the Gold Coast in a claim for misleading or deceptive conduct arising out of misrepresentations by a vendor and real estate agent. The Court of Appeal affirmed the factual findings of the trial judge, and gave judgment for the purchaser on the substantive issues in the appeal.
The case involved the resolution of numerous questions of law, including the operation of apportionment of liability provisions between concurrent wrongdoers, the effect of contractual exclusion clauses, as well as issues concerning practice and procedure.
