Damian Clothier KC (with Ms Julia Watson) represented the second respondent, Woodside Energy Scarborough, instructed by Allens.
The case concerned an application for a maximum costs order under r 40.51 of the Federal Court Rules 2011 (Cth) in the context of a substantive proceeding involving judicial review of a decision made by the National Offshore Petroleum Safety and Environmental Management Authority to accept an environment plan. Justice McElwaine decided that the case raised important questions about the lawful exercise of statutory power and hence, a maximum costs order was necessary to facilitate access to justice.
