In summary, this was a costs proceeding following a partially successful application by the defendants to strike out a Statement of Claim. Both parties asserted primacy over their individual successes on the application and that costs should reflect that. Ultimately, the Court held it was inappropriate to make a definitive costs order. In deciding this, the Court considered it undesirable to isolate individual issues and make costs orders based off a party’s respective losses or success, and that the application was an interlocutory application brought at an early stage which did not effectively determine the course of the proceedings.
