The applicant sought to appeal a decision which dismissed his claim against Facebook Australia for damages for breach of contract. The claim was dismissed because Facebook Australia did not provide the services used by the applicant. The Appeal Tribunal refused leave to appeal as there was no error in the primary decision and because the applicant had no arguable case. The evidence established that Facebook Australia had no contractual relationship with the applicant, and the applicant repeatedly ignored opportunities to substitute the correct respondent.
