The Plaintiff/Respondent was a contractor which seeks payment of approximately AUD 1.1 million from the Defendant/Applicant in connection with works at a subdivision development. The proceeding involves allegations about the effect of section 42 of the Queensland Building and Construction Commission Act 1991 and knowledge of licence issues. The Plaintiff alleged that other contracts were relevant to showing knowledge and that was resisted by the Defendant.
