An appeal and cross-appeal against a decision not to order a liability insurer to indemnify its insured. The issues included whether there was an occurrence within the meaning of the policy, whether the insured was to be indemnified in respect of a sum paid pursuant to a settlement agreement, and whether an exclusion clause in respect of professional services applied.
Angus O’Brien (led by RA Dick SC and PW Flynn) acted for the appellant, instructed by Herbert Smith Freehills.
The appeal and cross-appeal were dismissed. The judgment can be viewed here.
