Matthew Jones KC (with C D Martin) represented the respondent, instructed by Law Shared Pty Ltd.
This decision involved consideration of a contract for sale of a rent roll, being a composite bundle of rights rather than a contract to individually sell each appointment which made up the rent roll. It also applied the principle that damages for breach of contract may be assessed on a date later than the date of breach, namely on the date at which the party not unreasonably ceased to press its claim for specific performance.
