An application by the respondent to strike out paragraphs of the statement of claim alleging the respondent employer contravened s.340 of the Fair Work Act 2009 (Cth) by failing to renew a fixed-term contract. The matter arose from allegations made by a former employee that the employer misrepresented the terms of the employment contract to the former employee. The employee was also claiming damages for the loss of one year’s wages, and damages for the exacerbation of the anxiety and adjustment disorder they suffered because of the conduct of a supervisor.
