The second intervener, applied by interlocutory application for additional redactions to an Indigenous Land Use Agreement (ILUA) already the subject of a suppression order. The second intervener submitted certain clauses of the ILUA that revealed the mechanism or obligations of payments, and also that related to environmental management should be suppressed on the basis that suppression was necessary, to prevent prejudice to the proper administration of justice.
Her Honour ordered that pursuant to s 37AF(1) of the Federal Court of Australia Act 1976 (Cth), no third party should be entitled to access any copy of the ILUA without the specified redactions.
