This appeal concerned disputes arising between brothers as to who was beneficially entitled to the Durrandella property, as well as alleged breaches of director’s obligations. The Court considered three principle issues – firstly, what the true nature of the arrangements between the members of the Hinrichsen family were regarding ownership of Durrandella and the Croydon Properties, secondly, whether Neville owed a debt of $395,177 to Hinrichsen Pastoral, and thirdly, whether it was right to conclude that Neville had breached his duties as director to Hinrichsen Pastoral. The appeal was dismissed, with the matter remitted to the trial judge to make appropriate directions or other orders. The appellant was ordered to pay the respondents’ costs of the appeal.
