This case involved an Application by the former Chief Executive Officer of the Logan City Council against the Council and the former Mayor and Councillors. The proceedings alleged contraventions of the Public Interest Disclosure Act 2010 and the Industrial Relations Act 2016 and sought declarations, penalties, damages and injunctive relief.
After a 3 week hearing and numerous interlocutory matters, the Commission dismissed the Application. It accepted arguments from the Respondents about the correct interpretation of the relevant legislation and the impact of the evidence and in part dismissed the claim because of evidence given in cross-examination of the Applicant.
