Kristi Riedel represented the respondent, Chief Executive Officer, Civil Aviation Saftey Authority.
This application concerned a review by the Administrative Review Tribunal of a Civil Aviation Safety Authority (CASA) decision, where the Applicant was refused a medical certificate. The principal issue considered by the Tribunal was whether issuing a medical certificate to the Applicant was likely to have an adverse effect on the safety of air navigation. It was held by the Tribunal that the issuance of a medical certificate to the Applicant would be likely to have an adverse effect on the safety of air navigation, in light of the risks identified by CASA medical experts. Consequently, the authorisation of a medical certificate was not granted, and the decision under review was affirmed.
