Andrew O’Brien KC and Emily O’Brien appeared for the Appellant (pro bono), instructed by Gilshenan & Luton Legal Practice.
This case was an appeal from a conviction for unlawful assault causing grievous bodily harm. Ms Hasem contended that self-defence under ss 271 and 272 of the Criminal Code (Qld) was fairly raised on the evidence and should have been left to the jury, and that the trial judge erred by giving inadequate directions on alleged lies as evidence of consciousness of guilt. The Court of Appeal dismissed the appeal, holding that self-defence was not fairly raised on the evidence and that no error of law was made by the trial judge in the directions concerning the use of alleged lies as consciousness of guilt.
