This case concerns a deed dispute and a privity dispute between parties associated in an unincorporated joint venture for the exploration, testing, evaluating, and production of coal seam gas. The deed dispute concerned whether the defendant parties were obliged to pay the invoices issued by the first plaintiff for its share of the additional payment made pursuant to the final award. The Supreme Court of Queensland held that each defendant party was bound to pay the invoice. The privity dispute concerned whether the defendant parties were bound by the final award as privies of the plaintiff. The Court held that the defendant parties were not bound.
