The Second Plaintiff, as purchaser, entered into a Share Sale Agreement with the Second Defendant, as vendor, of shares in a company purporting to own land on which a prawn farm was operated on. The Plaintiff claimed that the Defendants made false or misleading representations to the Plaintiff that induced and caused the Second Plaintiff to enter into the Share Sale Agreement.
The Plaintiffs were successful on a separate question and it was found that representations were made, that they were false or misleading representations pursuant to s 52 or s 53A of the Trade Practices Act 1974 (Cth), and that they caused the Plaintiffs to enter into the Share Sale Agreement.
