Benjamin Teng co-authored this case note published in the University of Western Australia Law Review with Hannah Williams. It concerns the decision of the High Court of Australia in UBS AG v Tyne (as trustee of the Argot Trust) to find an abuse of process in less oppressive circumstances than it had ever before. The authors argue that this decision set a new high-water mark for the doctrine of abuse of process in Australia through the invocation of the case management principles articulated in the High Court’s decision in Aon Risk Services Australia Ltd v Australian National University.
