The law in relation to a trustee’s right of indemnity by way of exoneration or recoupment has been the subject of several decisions in recent years including by the High Court.
In this seminar, Paul and Anthony will explore the ability of a trustee to exercise that right where the trustee has been replaced including what use a former trustee may make of s 228 of the Property Law Act 1974 (Qld).
