This case concerned DGR’s application for leave to amend its further amended claim and second further amended statement of claim. The Court held that leave only be granted to DGR to amend the existing pleading as proposed, and that leave would not be granted to amend the existing pleading in an alternative fashion. The Court ordered that the parties must bring in draft orders reflecting the reasons of the Court.
