In this case Russells (the plaintiff) sues the defendants for an overdrawing of the first defendant’s share of the partnership income. It was held that when the first defendant retired, the Partnership dissolved. However, the Court did not agree that after dissolution of the Partnership, that Partners were entitled to the taking of an account. Hence, Russells was successful in its claim, and the defendants were requires to repay the overdrawing of the first defendant’s share of the income with interest pursuant to the partnership deed.
