This case concerned an application for a stay of a reviewable decision of the Civil Aviation Safety Authority (“CASA”), which cancelled a Certificate of Approval (“COA”) issued to it pursuant to regulation 30 of the Civil Aviation Regulations 1988 (“CAR”).
The Tribunal considered, inter alia, whether a failure to grant a stay would result in substantial economic hardship for the Applicant, and whether this would disrupt the regional aviation industry. The Tribunal held that the application for a stay be refused, and directed that the matter be listed for a final hearing.
