This case concerned a disagreement between the parties as to an appropriate cost order, following the primary decision of the Land Appeal Court. The appellants/cross-respondents sought an order that their standard costs of appearing before the Land Court and Land Appeal Court be paid, with the respondent/cross-appellant seeking, inter alia, an order for referral of the costs for the Land Court back to the Land Court. The Court considered the application of section 57A(2) of the Land Court Act 2000, and held that the respondent/cross-appellant pay the appellants/cross-respondents’ cost of and incidental to the appeal and cross-appeal, and that the respondent/cross-appellant pay the costs of the appellants/cross respondents of and incidental to sittings before the Land Court of Queensland.
