Andrew O’Brien appeared for the respondents, instructed by Corrs Chambers Westgarth.
The respondents resist the Landlords’ application for a declaration that they are required upon termination of the lease to remove all the “Tenant’s Property” from the leased premises and make good any damage caused by the removal. It was held that the Lease terms did not indicate an objective intention to impose a requirement that the respondents remove the Tenant’s Property. The application for the declaration was dismissed.
