The Board of Trustees of Q Super (for whom Matthew Hickey appeared) had rejected the complainant’s claim for a total and permanent disablement benefit, which decision was reviewed by the Superannuation Complaints Tribunal, which affirmed the Trustees’ decision.
On appeal to the Federal Court of Australia, Chief Justice Allsop held that the Tribunal had erred by failing to engage with critical parts of medical evidence before it.
