Darling v Daniels [2025] FCA 81 concerned a strike out application by the respondents of impugned paragraphs in the proposed amended claim. These paragraphs advanced the alleged basis of the respondent’s participation in the publication of alleged defamatory material and their alleged vicarious liability. The principal issue was whether the impugned paragraphs met the requirements for a pleading. The Court ordered the impugned paragraphs be struck out as there was substantial uncertainty regarding the fundamental nature of the claims being advanced.
