The judgment was a hearing as to costs following earlier proceedings concerning the scope of an Independent Expert’s authority under a contract between the parties. Both parties had partial success. Pursuant to rule 681 of the Uniform Civil Procedure Rules (Qld) and each party’s relative success in the dispute, the Court ordered Downer to pay 80% of John Holland’s costs of both proceedings, assessed on the standard basis if not agreed.
