Owners in an unhappy duplex fell into in dispute about the maintenance. The dispute was adjudicated, but the body corporate failed to comply with the order.
The court appointed an administrator under s287 of the Body Corporate and Community Management Act 1997 (Qld) to bring the body corporate into compliance with the adjudicator’s order.
Dissatisfied with the outcome, an owner sought leave to appeal the appointment and to stay the administrator’s work pending determination of the appeal. On the grounds that the case did not involve an important question of law or justice, the court refused leave and dismissed the application for a stay.
