This judgement was published in addition to the Court’s reasons in respect of the claim and counterclaim, concerning the issues of final orders and costs. The Court considered the timing of the remedial works, the scope of the remedial works, and the process for a survey to be undertaken to verify compliance with the order.
It was held that the Plaintiff’s claim be dismissed, and judgement be entered for the Defendants against the First and Second Plaintiffs on the Defendants’ Amended Counterclaim. The First and Second Plaintiffs were ordered, inter alia, to remove the Temporary Levee and restore the Below-Ground Drain to Natural Ground Level, upon which written notice must be provided to the Defendant.
